Account Creation: In order to access certain features and functionality of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
Content and Intellectual Property: The App may contain user-generated content, including reviews, ratings, and photos. By submitting content to the App, you grant GoingOut a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, distribute, and display such content.
Privacy: GoingOut respects your privacy and handles your personal information in accordance with its Privacy Policy. By using the App, you consent to the collection, use, and disclosure of your personal information as outlined in the Privacy Policy.
Subscription and Payment: Some features and services within the App may require a subscription. By subscribing, you agree to pay the applicable fees and charges through the Stripe payment gateway. Subscriptions will automatically renew at the end of each billing cycle unless canceled. You may cancel your subscription at any time, but a one-month notice period is required for cancellation.
Newsletter: By using the App, you may have the option to subscribe to the GoingOut newsletter. By subscribing, you consent to receive periodic email updates and promotional content related to the App and its services. You can unsubscribe from the newsletter at any time by following the instructions provided in the emails.
Accuracy of Information: While we strive to provide accurate and up-to-date information, GoingOut does not warrant the accuracy, completeness, or reliability of any content available on the App. The information provided is for general informational purposes only and should not be relied upon for making decisions.
Third-Party Apps: The GoingOut App may integrate with or provide links to third-party applications, including but not limited to Google Maps, Google Place Search, Google Find Direction, Google Translate, and APILayer for currency conversion. These third-party apps are provided for your convenience and may have their own terms and conditions and privacy policies. GoingOut does not endorse, control, or assume any responsibility for the content, functionality, or actions of these third-party apps.
a. Google Maps, Google Place Search, Google Find Direction, and Google Translate: These apps are used for location-based services, navigation, and translation purposes. Your usage of these third-party apps is subject to their respective terms and conditions and privacy policies. You acknowledge and agree that GoingOut shall not be liable for any damages or losses arising from your use of these third-party apps.
b. APILayer: APILayer is used for currency conversion within the GoingOut App. The currency conversion rates provided by APILayer are for informational purposes only and may not reflect real-time or accurate rates. Your usage of APILayer for currency conversion is subject to their terms and conditions and privacy policies. GoingOut shall not be liable for any discrepancies, errors, or damages arising from the use of currency conversion data provided by APILayer.
Limitation of Liability: In no event shall GoingOut be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App or the information provided on the App, to the extent permitted by Swiss law.
Indemnification: You agree to indemnify and hold GoingOut, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses, including attorney's fees, arising out of your use of the App or violation of these Terms and Conditions.
Modification of Terms: GoingOut reserves the right to modify or update these Terms and Conditions at any time without prior notice. It is your responsibility to review the Terms and Conditions periodically for any changes.
Termination: GoingOut may, at its sole discretion, terminate or suspend your access to the App, without notice or liability, for any reason, including if you breach these Terms and Conditions.
Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Switzerland.
